PERMANENT SOUTH AFRICAN RESIDENCE

Residence on Other Grounds

The Department may issue a permanent residence permit to a foreigner of good and sound character who:

1. Has received an offer for permanent employment.

Documentation required:
BI-947 - Application form.
Two passport size photographs (click here for details).
A full set of fingerprints.
Radiological report (excluding pregnant women and children under the age of 16 years).
Medical report.
Unabridged birth certificate.
Marriage certificate / proof of spousal relationship (where applicable).
Divorce decree / proof of legal separation.
Proof of custody / maintenance (where applicable).
Consent from parents of minors (where applicable).
Proof of judicial adoption (where applicable).
Proof of legal separation (where applicable).
Death certificate in respect of late spouse (where applicable).
Police clearance certificates in respect of all applicants 21 years of age and older for all countries where they might have resided for a period of one year or longer.
Certificates supporting highest educational, trade and / or professional qualifications.
Work references or certificates of service (covering at least the last five years).
Valid temporary residence permit, if the applicant is already in South Africa.
Offer of permanent employment.
Certification from a chartered accountant acting on behalf of applicant's prospective permanent employer that the position exists and that the position and related job description were advertised in the prescribed form and no suitably qualified citizen or resident was available to fill it.
Certification from the Department of Labour that the terms and conditions of such an offer, including salary and benefits, are not inferior to those prevailing in the relevant market segment for citizens or residents, taking into account applicable collective bargaining agreements and other standards.
Confirmation that the application falls within the yearly limits of available permits prescribed from time to time for each sector of industry, trade and commerce, after consultation with the Departments of Trade and Industry, Labour, and Education.
Payment of prescribed fee.

Conditions:
  - The holder shall remain employed in the field in respect of which the offer of employment was made, for a period of at least two years or alternatively a condition determined by e.g. the Department of Health.
