Direct Residence

2. The applicant is the spouse of a South African citizen or permanent resident provided that a good-faith spousal relationship exists.

Documentation required:
Identity document / permanent residence permit in respect of the South African spouse.
Declaration of support from the spouse who is the citizen / resident.
Proof in the form of communal accounts or other documents reflecting cohabitation (where applicable).
If the foreign spouse is a refugee, he / she must submit an affidavit with regard to all aliases used.

Two passport size photographs (click here for details).
A full set of fingerprints.
Radiological report (excluding pregnant women and children under the age of 16 years).
Medical report.
Unabridged birth certificate. (If the applicant is a refugee, he / she could submit a sworn affidavit in respect of the country fled from).
Marriage certificate / proof of spousal relationship (where applicable).
Divorce decree / proof of legal separation (where applicable). (If the applicant is a refugee, he / she could submit a sworn affidavit in respect of the country fled from).
Proof of custody / maintenance (where applicable).
Consent from parents of minors (where applicable).
Proof of judicial adoption (where applicable).
Proof of legal separation (where applicable).
Death certificate in respect of late spouse (where applicable).
Police clearance certificates in respect of all applicants 21 years of age and older for all countries where they might have resided for a period of one year or longer. (If the applicant is a refugee, he / she could submit a sworn affidavit in respect of the country fled from).
Valid temporary residence permit, if the applicant is already in South Africa.

Conditions:
  - The permit is issued on condition that it shall lapse if, at any time within three years from its application, the good-faith spousal relationship no longer subsists. Note that the applicant and the South African spouse have to arrange for an interview after three years to satisfy the Department concerned that the spousal relationship still subsists.
